This is the fourth chapter of Part Two, which presents twelve questions and answers relating to domestic lawyers specializing in real estate finance in Germany. The term property finance in Germany is understood to mean the financing of the acquisition or development of real property. Key topics discussed in this chapter include the principal securities that lenders require borrowers to provide; the statutory provisions that apply to such securities; specific statutory provisions and their application in real estate financing; and the share pledge that attributes to the pledge. While the agreements governing the acquisition of the property are typically governed by German law, it has become common for finance documents (with the notable exception of the security agreements) to be subject to the laws of England and Wales. As a general rule, the choice of laws other than those of the Federal Republic of Germany is admissable.
