Case Comments - The European Commission's Decision Against Microsoft: A Violation of the Antitrust Agreements Between the United States and the European Union? Members of US Congress claim that the European antitrust actions against Microsoft have violated the antitrust agreements between the United States and the European Union. An analysis of the case and the antitrust agreements on cooperation and comity demonstrate that these claims are legally unsubstantiated but also show shortcomings in the agreements that need further development. Case Comments - OFT Clears Sale of Telegraph Group to Barclay Brothers - Britain's reclusive Barclay brothers successfully wrestled away ownership of the Telegraph Group from Hollinger International in June 2004, when it was announced that their Press Acquisitions Limited had agreed to pay (GBP)729.5 million for the company. The Group's crown jewel is the Daily Telegraph newspaper, Britain's best-selling quality broadsheet. After the OFT cleared the deal on October 11, 2004, the curtain finally came down on one of the most complex business transactions in recent memory. This analysis takes a closer look at the OFT examination and argues that the proper conclusion was reached.Murphy, Gavin et al. | 2005

The Correct Approach to the Use of Empirical Analysis in Competition Policy - While economic theory can give competition practitioners important insights, it often becomes very complex, involving the use of complicated techniques that can make the expert economic evidence hard to evaluate. This paper discusses the correct way to present empirical analysis, so as to make the analysis as accessible as possible. We also explore the use of more simple forms of empirical analysis as useful complements to more complex forms of analysis.Florian, Pablo et al. | 2005

Commitment Decisions: An Australian Perspective - Commitment decisions are set to become an important part of the European Commission's enforcement tools. Commitment decisions move away from the traditional adversarial model, adopting a more co-operative negotiation based approach to resolving investigations. In Australia a similar tool was introduced in 1992. This article reviews the Australian experience and examines the strengths and weaknesses of the respective regimes.Eibl, Sonja et al. | 2005

The Revised Swiss Competition Law Direct Fines, Leniency and Notification - The Revised Swiss Cartel Act has introduced fundamental changes to Swiss competition law. Today, large fines can be imposed for horizontal hard-core cartels, vertical agreements providing for resale price maintenance or absolute territorial protection and for the abuse of a dominant position. Also, dawn raids will be permissible. These fundamental changes go partly beyond EC law and will make it necessary for companies to scrutinise their practices.Meinhardt, Marcel et al. | 2005

Price Discrimination, a Tender Story - This is a contribution to the current discussion on the reform of Art.82 of the EC Treaty. The authors argue that price discrimination by dominant companies is not necessarily anti-competitive and may be economically beneficial. A per se approach to price discrimination therefore is not justified.Lorenze, Moritz et al. | 2005
